Criminal Prosecutions Attorney
Job Description and Duties
Are you a poised criminal prosecutor who wants to be part of a dynamic vertical prosecution team? Are you interested in protecting the most vulnerable members of our communities and in helping to safeguard our state’s healthcare programs? We are seeking experienced criminal prosecutors to join our team in the Division of Medi-Cal Fraud and Elder Abuse (DMFEA), in our Orange Regional Office. DMFEA investigates and prosecutes fraud committed against California’s Medi-Cal programs and abuse and neglect committed against elder and dependent adults. The Deputy Attorney General (DAG) in this position prosecutes complex criminal cases in state courts, including (1) fraud committed by Medi-Cal providers, such as licensed physicians, pharmacists, and nurses, and (2) criminal abuses and neglect of elder and dependent adults residing in nursing homes and other residential care facilities.
The DAG filling this position will be part of a vertical multidisciplinary prosecution team, in which the criminal prosecutors (DAGs) work closely with members of their partner disciplines, like DMFEA special agents, investigative auditors and crime analysts. The DAG advises, coordinates and collaborates with agents, auditors and analysts on criminal cases; jointly develops investigative plans; reviews reports, search and arrest warrants; and, makes filing decisions for criminal charges. The DAG’s main tasks include legal research and writing, regular appearances in state courts, from case filings to sentencing as well as the presentation of evidence at hearings, grand juries and
trials.
Additional duties may include prosecuting crimes involving drug diversion of opioids and other controlled substances; cooperating with partner agencies tasked with the administration and regulation of the Medi-Cal programs and residential care facilities; collaborating with healthcare professionals and experts, such as experts on standard of care, computer and forensic experts, money laundering and asset freeze and forfeiture experts; and, liaising with federal, state and local law enforcement partners, as well as out-of-state law enforcement agencies and Attorney General Offices.
This position requires the DAG’s ability to travel to neighboring counties for court appearances, including occasional overnight or extended duration for meetings, conferences and hearings.

Working Conditions
This position may be eligible for telework. The amount of telework is at the discretion of the Department and based on DOJ's currenttelework policy. While DOJ supports telework, in-person attendance may be required based on operational needs. Employees areexpected to be able to report to their worksite with minimal notification if an urgent need arises.

Please note that appointment to the DAG classifications will be made using the following examinations:
DAG/Attorney exam – less than 5 years of experience: DAG/Attorney Examination
- DAG III exam– at least 5 years of legal experience: DAG III Examination
- DAG IV exam– at least 6 years of legal experience: DAG IV Examination You do not have to take an exam before you apply for a job. However, you must complete and pass the exam to be eligible for hire.
